1. Acceptance of Terms

By accessing or using Daigram ("the Service"), operated by Gavin Somers trading as Daigram, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Daigram is a web application that converts YouTube video transcripts into visual diagrams using artificial intelligence. The Service requires an account and credits to generate diagrams.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when creating your account.

4. Credits and Payments

• New accounts receive 5 free credits.
• Each diagram generation consumes 1 credit.
• Additional credits can be purchased through the Service.
• All purchases are final and non-refundable, except where required by law.
• Credits do not expire.
• Payments are processed securely by Stripe. We do not store your payment card details.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, exploit, or disrupt the Service.
• Use automated tools to access the Service without permission.
• Resell or redistribute generated diagrams as a competing service.

6. Intellectual Property

Diagrams you generate are yours to use. However, the underlying technology, branding, and Service design remain the property of Daigram. The source YouTube content remains the property of its respective owners.

7. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee the accuracy of AI-generated diagrams. Diagrams are intended as learning aids and should not be relied upon as authoritative sources.

8. Limitation of Liability

To the maximum extent permitted by law, Daigram shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding any claim.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination by us for reasons other than your violation of these Terms, we will refund unused purchased credits on a pro-rata basis. Otherwise, unused credits are forfeited.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Continued use of the Service after changes constitutes acceptance.

11. Dispute Resolution

These Terms are governed by the laws of England and Wales. EU consumers may also use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
